ai sensi del D.LGS. 196/2003 e s.m.i. (il “Codice Privacy”) e del Regolamento UE 2016/679 (il “GDPR” o il “Regolamento”)

Gentile Cliente, nel rispetto della normativa vigente in materia di protezione dei dati personali, Tenuta Sant’Antonio della Famiglia Castagnedi S.A., con sede in San Zeno di Colognola ai Colli, Via Ceriani n. 23, in qualità di Titolare di trattamento, utilizzerà i suoi dati per svolgere le attività di seguito elencate:

  • A. Fidelizzazione: rilascio di credenziali per l’accesso alla Sezione VIP (la “VIP”) e gestione delle attività non esercitabili in forma anonima e necessarie per consentire ai sottoscrittori la fruizione e il riconoscimento di promozioni, l’offerta e l’invio di premi, la partecipazione a raccolte punti e ad eventi promozionali riservati alla clientela fidelizzata oltre all’accesso ai servizi accessori fruibili mediante la VIP (vantaggi elencati sul ns. portale e-commerce https://shop.tenutasantantonio.it/). Alla clientela fidelizzata è altresì riservata la possibilità di effettuare acquisti on line di prodotti del Titolare, accedendo al portale e-commerce https://shop.tenutasantantonio.it/.

I campi indicati come obbligatori (contrassegnati da un asterisco) se non compilati comporteranno l’impossibilità di rilasciare le credenziali VIP.

I dati facoltativi, ove non forniti, non comporteranno conseguenze sul rilascio delle credenziali VIP e sulla partecipazione alle promozioni ad essa associate. La valutazione dei dati obbligatori è stata fatta tenendo conto dei principi di necessità e proporzionalità nel trattamento in ossequio al Codice Privacy, al Regolamento Privacy e a tutte le specifiche normative di settore.

Per le finalità di cui alla lettera a), il conferimento dei dati è facoltativo, ma costituisce condizione necessaria ed indispensabile rispettivamente per il rilascio delle credenziali VIP ed usufruire dei servizi e benefici ad essa connessi: il mancato conferimento comporta per il richiedente rispettivamente l’impossibilità di ottenere le credenziali VIP ed i connessi servizi e vantaggi nonché l’impossibilità di effettuare acquisti on-line di prodotti del Titolare. La base giuridica del trattamento è, infatti, l’esecuzione dei servizi forniti attraverso le credenziali VIP (sensi dell’articolo 6, comma 1, lett. b del Regolamento Privacy).

I dati da Lei forniti verranno trattati prevalentemente con strumenti informatici sotto l’autorità del Titolare del trattamento, da parte di personale specificatamente incaricato, autorizzato ed istruito al trattamento ai sensi degli articoli 28 e 29 del Regolamento Privacy e dell’articolo 2 quaterdecies del Codice Privacy. La informiamo che sono osservate idonee misure di sicurezza, anche ai sensi degli artt. 5 e 32 del Regolamento Privacy, per prevenire la perdita dei dati, usi illeciti o non corretti ed accessi non autorizzati.

Fatti salvi gli obblighi di legge, i dati personali saranno conservati per tutta la durata della Sua partecipazione al programma di Fidelizzazione. In ogni caso, i dati relativi al dettaglio degli acquisti con riferimento a clienti individuabili possono essere conservati per finalità di Profilazione e di Marketing per un periodo non superiore a 24 mesi dalla loro registrazione, salva la reale trasformazione in forma anonima che non permetta, anche indirettamente o collegando altre banche di dati, di identificarLa. In caso di eventuale disabilitazione (nei termini previsti dal regolamento) i Suoi dati potranno venire conservati per esclusive finalità amministrative per un periodo di 3 mesi (fatti salvi eventuali specifici obblighi di legge sulla conservazione di documentazione amministrativa e contabile).

I Suoi dati potranno essere comunicati, all’interno dell’UE, nel pieno rispetto di quanto previsto dal Regolamento Privacy, ai seguenti soggetti:

  • (i) all’amministrazione finanziaria e/o altre autorità pubbliche, ove ciò sia imposto dalla legge o su loro richiesta;
  • (ii) alle strutture, ai soggetti ed alle società esterne di cui il Titolare si avvale per lo svolgimento di attività strumentali e/o accessorie alla gestione del programma di Fidelizzazione o l’erogazione dei servizi e benefici ad essa connessi, ivi compresi i fornitori di soluzioni software, web application e servizi di storage erogati anche tramite sistemi di Cloud Computing (tutti i dati saranno custoditi su server situati nel territorio della Comunità Europea);
  • (iii) ai consulenti esterni (ad esempio, per la gestione degli adempimenti fiscali), se non designati per iscritto Responsabili del trattamento.

L’elenco aggiornato dei Responsabili del trattamento designati può essere fornito su richiesta da parte degli interessati.

Si ricordi che in qualsiasi momento potrà esercitare i diritti di cui agli artt. aal 15 al 22 compresi del Regolamento Privacy, nelle modalità stabilite dall’art.12 del Regolamento Privacy, e, per l’effetto, ottenere:

  • la conferma dell’esistenza o meno di Suoi dati personali con indicazione della relativa origine, verificarne l’esattezza o richiederne l’aggiornamento, la rettifica, l’integrazione;
  • l’accesso, la rettifica, la cancellazione dei dati o la limitazione del trattamento;
  • la cancellazione, trasformazione in forma anonima o il blocco dei dati trattati in violazione di legge.

Potrà, inoltre, opporsi al trattamento dei dati che la riguardano.

Qualora la Nostra Società non Le fornisca riscontro nei tempi previsti dalla normativa o la risposta all’esercizio dei suoi diritti non risulti idonea, potrà proporre ricorso al Garante per la protezione dei dati personali.
